These Terms & Conditions ("Terms") govern your access to and use of this website and the services provided by DigiGrowvity, a brand operated by Eunice Enterprises, a proprietorship registered in India. By accessing this website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2. Services Offered
DigiGrowvity provides digital marketing and related professional services, including but not limited to Search Engine Optimization, Google Ads / PPC advertising, Meta Ads, website design and development, e-commerce website development, social media management, content writing, branding and logo design, local SEO / Google Business Profile optimization, digital marketing consultation, and both monthly retainer and one-time project-based services. Services are provided globally, including clients in India and international customers.
3. Service Engagement & Payments
- All services require advance payment before work commencement.
- Pricing is provided through custom quotations and billed in INR only.
- Payments are accepted via UPI, Credit/Debit Cards, Net Banking, and Razorpay.
- DigiGrowvity reserves the right to pause or withhold services in case of delayed or failed payments.
4. Cancellations & Refunds
Cancellation terms and our refund policy are set out in full in our dedicated Refund & Cancellation Policy, which forms part of these Terms by reference.
5. Service Timelines & Expectations
- SEO results typically take 3–6 months to show measurable progress.
- Website design and development projects are typically completed within 2–4 weeks, subject to scope and client inputs.
- Google Ads and Meta Ads setup generally takes 3–5 working days after payment and receipt of required access.
DigiGrowvity does not guarantee specific results, rankings, traffic, leads, or sales, as outcomes depend on external factors such as algorithms, platform policies, competition, and market conditions.
6. Client Responsibilities
Clients agree to provide website content, brand assets, timely approvals and feedback, required access to ad accounts and platforms, domain and hosting (if not purchased via DigiGrowvity), and compliance with Google, Meta, and other third-party platform policies. Delays caused by the client will automatically extend project timelines without penalty or liability to DigiGrowvity.
7. Intellectual Property Rights
All website code, creatives, designs, strategies, and marketing assets remain the property of DigiGrowvity until full payment is received. Upon full payment, ownership is transferred to the client, excluding third-party tools, plugins, licenses, or platforms. DigiGrowvity retains the right to showcase completed work in its portfolio, website, marketing materials, case studies, and testimonials, including use of the client's name and logo.
8. Limitation of Liability
DigiGrowvity / Eunice Enterprises shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, data, revenue, or business opportunities, including from website downtime, algorithm changes, ad account suspension, or platform policy actions. Our total liability, if any, shall not exceed the amount paid by the client for the specific service.
9. Indemnification
You agree to indemnify and hold DigiGrowvity / Eunice Enterprises harmless from any claims, damages, liabilities, and expenses arising from your breach of these Terms, misuse of our services, or content and materials you provide that infringe third-party rights.
10. Third-Party Services
DigiGrowvity may use third-party platforms such as Google, Meta, and Razorpay. We are not responsible for changes, outages, suspensions, or policy enforcement by these platforms.
11. Force Majeure
Neither party shall be liable for delays or failure to perform obligations under these Terms resulting from events beyond its reasonable control, including natural disasters, internet or platform outages, government action, or other unforeseeable circumstances.
12. Termination of Services
DigiGrowvity reserves the right to terminate or suspend services if the client violates these Terms, payment obligations are not met, or the client engages in unlawful, unethical, or abusive behavior. Refunds, where applicable, remain governed exclusively by our Refund & Cancellation Policy.
13. Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation, and if unresolved, through mediation, before pursuing litigation. This clause does not limit either party's right to seek urgent injunctive relief where necessary.
14. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Subject to Section 13, all disputes shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. DigiGrowvity may assign these Terms in connection with a merger, acquisition, or sale of assets.
17. Electronic Communications
By engaging our services, you consent to receive communications from us electronically, including via email and WhatsApp, and agree that such communications satisfy any legal requirement that they be in writing.
18. Entire Agreement
These Terms, together with any signed proposal or quotation, constitute the entire agreement between you and DigiGrowvity regarding the services, superseding any prior agreements or understandings.
19. Modifications
DigiGrowvity reserves the right to modify these Terms at any time. Updated Terms will be effective immediately upon posting on the website, and the "Effective Date" above will reflect the latest revision.
